Loyal Studio provides a service that transforms pet photos into artistic portraits through digital and physical print formats. Our Service includes:

• Digital portrait creation and file delivery
• Physical print production and shipping
• Online previews and file delivery
• Customer support and order management

3. Account Responsibilities

If you create an account, you are responsible for:

• Maintaining the confidentiality of your password
• All activities that occur under your account
• Notifying us immediately of any unauthorised use
• Providing accurate and complete information

You must be at least 13 years old to create an account. By creating an account, you represent that you meet this age requirement.

4. Orders and Payment

4.1 Order Acceptance

We reserve the right to refuse or cancel any order for any reason, including but not limited to:

• Product or service availability
• Errors in pricing or product information
• Suspected fraudulent activity
• Inappropriate or offensive content

4.2 Pricing

All prices are displayed in Australian Dollars (AUD) unless otherwise stated. We reserve the right to modify prices at any time without prior notice. However, prices for confirmed orders will not be changed.

4.3 Payment

Payment is due at the time of placing your order. We accept payment via credit card and other payment methods as displayed on our website. By providing payment information, you represent that you are authorised to use the payment method.

5. Production and Delivery

5.1 Digital Files

Digital files are generated after checkout; timing varies.

5.2 Physical Prints

Physical prints are produced after checkout. Production times and shipping estimates are provided on our website. These estimates are not guaranteed and may vary due to factors beyond our control.

5.3 Shipping

Shipping times are estimates and not guarantees. We are not liable for delays caused by shipping carriers, customs, or other factors outside our control. Risk of loss transfers to you upon delivery to the shipping carrier.

6. Approval and Revisions

We share previews where available, and production proceeds based on the preview you see.

We are not obligated to provide revisions unless there is a production error on our part. Reasonable revision requests may be accommodated when possible.

7. User Content and Licences

7.1 Your Photos

You retain ownership of any photos you upload to our Service. By uploading photos, you grant us a limited, non-exclusive, royalty-free licence to use, modify, and display your photos solely for the purpose of fulfilling your order.

7.2 Generated Portraits

Upon payment and completion, you receive a licence to use the generated portrait for personal, non-commercial purposes. This includes:

• Personal display and sharing
• Printing for personal use
• Social media sharing

Commercial use, resale, or redistribution of the portraits requires explicit written permission from Loyal Studio.

7.3 Portfolio and Marketing Use

Loyal Studio reserves the right to use generated artwork (the portrait output, not your original photos) for portfolio display, social media marketing, website galleries, and promotional materials. This helps us showcase our art styles and grow the service for all users.

If you prefer that your generated portrait not be used in this way, you may opt out at any time by contacting us at loyalstudio.ltopbb@gmail.com with your order number. We will remove your portrait from any marketing materials within a reasonable timeframe.

For clarity: your original uploaded photos are never used for marketing purposes. Only the generated artwork output may be used as described above, and only until you opt out.

7.4 Content Standards

You agree not to upload content that is illegal, offensive, or violates the rights of others. We reserve the right to refuse service for such content.

8. Refunds and Cancellations

9. Intellectual Property

9.1 Our Property

All content on our website, including text, graphics, logos, images, and software, is owned by Loyal Studio or our licensors and is protected by copyright and other intellectual property laws.

You may not reproduce, modify, distribute, or create derivative works of our content without prior written consent, except as necessary for your personal use of the Service.

10. Disclaimers and Warranties

Our Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that:

• Results will meet your expectations
• Any errors will be corrected

10.2 Portrait Variations

Artistic portraits involve interpretation and stylistic choices. While we strive for accuracy and quality, variations from the original photo are inherent to the artistic process and do not constitute defects.

11. Limitation of Liability

To the fullest extent permitted by law, Loyal Studio shall not be liable for:

• Indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Damages exceeding the amount you paid for the applicable order

This limitation applies to actions based on warranty, contract, tort, or any other legal theory.

12. Indemnification

You agree to indemnify and hold harmless Loyal Studio from any claims, damages, losses, and expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights

We may terminate or suspend your account and access to the Service at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
